The Obama Administration’s Immigration
Announcement of June 15, 2012 is NOT an Amnesty Program!

What the new policy is NOT:
The Obama Administration announcement is NOT an amnesty. It is NOT about granting legal status. It is NOT a path to citizenship and it is not a permanent fix.

What the new policy is:
1. Deferred Action for Childhood Arrivals - DACA: Temporary relief for illegal immigrants with no criminal records who entered the United States before the age of 16 and are now under 30 years old
(see DACA).
The Obama Administration announcement is NOT an amnesty. It is NOT about granting legal status. It is NOT a path to citizenship and it is not a permanent fix. Under this policy, you will not be deported if:

* You entered the United States before age 16 and
* You were under 31 years old and present in the United States on June 15, 2012
* You have no criminal history
* You have been in the United States at least 5 continuous years
* You have a high school degree or equivalent, are in school, or you have served in the military

If you qualify you will be immune from deportation and be able to apply for a work permit good for two years. There is currently no limit on how many times this work permit can be renewed.

2. Prosecutorial Discretion
For the record, prosecutorial discretion has always been availabe. This is where the Department of Homeland Security, DHS decides in their discretion whether to issue an NTA (Notice to Appear), terminate proceedings or attempt to deport an an immigrant. Decisions are made in the totality of the circumstances on a case by case basis. Prosecutorial discretion is often given to immigrants with clean records and family ties in the US who are considered to be low priority enforcement cases and have no other means of legalizing their status.

IMPORTANT: No status is given. You will NOT be able to get a work permit and you will NOT be able to get a driver's license. You are simply put back in the situation you were in before you were detained or questioned.

Do NOT believe anyone who tells you they get you legal status based on President Obama's announcement of June 15, 2012, the "Dream Act" or Prosecutorial Discretion. Anyone who says that is not to be trusted! Be very careful that you fit into these parameters. If you do not fit into these parameters, remember that there is NO “safe” way to turn yourself in to immigration and there is NO guarantee that your case will be considered “low priority.” ANY person who comes into contact with immigration authorities may be arrested, detained or even removed.
